1. Acceptance of these terms

These Terms of Use ("Terms") govern your use of the website at https://www.campperrybsa.com/ (the "Site"). The Site is run by a small independent editorial team based in Texas, USA, referred to here as "we", "us" or "our". By visiting or using the Site, you agree to these Terms and to our Privacy Policy, Cookie Policy and Disclaimer, which are part of these Terms. If you do not agree, please do not use the Site.

2. About this site

An independent community resource

The Site is an independent community, alumni and information resource about Camp Charles F. Perry, the Scout camp on the Arroyo Colorado in Rio Hondo, Texas. It shares camp history, program overviews, planning tips, articles and community news.

No affiliation

The Site is not operated by, affiliated with, sponsored by or endorsed by Scouting America (formerly the Boy Scouts of America) or the Rio Grande Council. Nothing on the Site is an official statement of either organization. For official information, visit the council's Camp Perry page.

No registrations, payments or donations

We do not register campers or units, book facilities, sell merchandise, collect fees or accept donations through the Site. Any links to register or give take you to the council's own website, where that organization's terms apply. Submitting our contact form does not reserve a date, place a booking or create any agreement with the council or the camp.

3. Who may use the site

The Site is open to the public and is intended for a general audience, including Scout families, unit leaders, alumni and community members. Young people are welcome to read the Site, but our contact form and newsletter sign-up are meant to be used by adults. If you are under 18, please ask a parent, guardian or adult leader to contact us on your behalf. We do not knowingly collect personal information from children under 13; see our Privacy Policy for details.

4. Informational use only

Content on the Site is provided for general information. Camp facilities, programs, schedules, prices, dates and requirements are set by the council and can change at any time, sometimes without notice. Historical information, including details of the 2017 "¡Adelante Con Camp Perry!" capital campaign, is presented as a record of the past and may not describe current plans or conditions.

Articles about heat safety, water safety, health and outdoor skills are general guidance only. They are not medical, legal or professional advice and do not replace official Scouting America safety policies, trained leaders or your own judgment. Please read our Disclaimer for more.

5. Acceptable use

We want the Site to stay useful and welcoming for everyone. When using it, you agree not to:

• Use the Site in any way that breaks the law or infringes anyone else's rights.
• Submit false information, impersonate another person or organization, or suggest that you speak for the council or Scouting America when you do not.
• Send spam, chain letters, advertising or bulk messages through our forms.
• Submit content that is abusive, harassing, threatening, hateful, obscene or that could endanger a young person.
• Try to gain unauthorized access to the Site, its hosting servers or any connected systems, or probe, scan or test their vulnerability.
• Interfere with the Site's operation, for example by overloading it, introducing malware or using automated tools to flood our forms.
• Scrape or copy large portions of the Site's content by automated means for republication or commercial use.
• Frame or mirror the Site, or present its content in a way that suggests it is your own or officially endorsed.

We may block access, ignore submissions or take other reasonable action if we believe these rules have been broken.

6. Your submissions

Contact form and email

When you send us a message, you confirm that the information you provide is accurate and that you are entitled to share it. We will use it as described in our Privacy Policy: to reply to you, and nothing more. We try to answer every genuine message, but we cannot promise a response time or guarantee that we can answer every question, especially questions only the council can resolve.

Newsletter

If you sign up for our newsletter, we will send occasional updates to the email address you provide. You can unsubscribe at any time using the link in any newsletter email.

Ideas, stories and feedback

If you send us suggestions, corrections, memories of camp or other feedback, you allow us to use them to improve the Site without paying you or owing you anything. If you send a story, photo or other material that you want us to publish, we will ask for your permission and discuss credit before publishing it. You keep ownership of anything you send; you simply grant us a non-exclusive, royalty-free license to use it for the Site as agreed. Please do not send photos of other people, especially young people, unless you have their (or their parent's) permission.

7. Intellectual property

Our content

Unless otherwise noted, the text, page designs, layout and original graphics on the Site are owned by us or used with permission and are protected by copyright and other laws. You may view, print and share pages for personal, non-commercial use, such as sending a packing list to your troop, as long as you keep any credit and do not change the content. Any other use, including republishing articles on another website, requires our written permission.

Third-party marks and materials

"Scouting America", "Boy Scouts of America", the fleur-de-lis emblem, and related names, logos and marks belong to their respective owners. The historical "¡Adelante Con Camp Perry!" campaign logo and other archival materials from the original 2017 site are shown for historical and informational purposes only. Their appearance on the Site does not grant you any right to use them and does not imply endorsement. See the trademark notice in our Disclaimer.

Photographs

Some photographs on the Site are illustrative images used under their respective licenses and may not show Camp Perry itself. Photographs remain the property of their owners and may not be reused without permission from those owners.

8. Copyright complaints

We respect the rights of creators. If you believe material on the Site infringes your copyright, email [email protected] with the subject line "Copyright notice" and include:

1. Your name and contact details.
2. A description of the copyrighted work you believe has been infringed.
3. The address (URL) of the page where the material appears.
4. A statement that you believe in good faith that the use is not authorized by the owner, its agent or the law.
5. A statement that the information in your notice is accurate and that you are the owner or authorized to act for the owner.
6. Your physical or electronic signature.

We will review valid notices promptly and remove or correct material where appropriate.

9. Links to other websites

The Site links to websites run by others, including the Rio Grande Council, scouting.org and government agencies. These links are provided for convenience. We do not control those sites and are not responsible for their content, accuracy, availability, privacy practices or terms. Visiting them is at your own risk and subject to their own policies.

10. Disclaimer of warranties

We work hard to keep the Site accurate and available, but it is provided "as is" and "as available". To the fullest extent allowed by law, we make no warranties of any kind, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, non-infringement, or that the Site will be uninterrupted, secure or free of errors or harmful components. Always confirm important details, such as dates, fees, requirements and safety rules, directly with the council.

11. Limitation of liability

To the fullest extent allowed by law, we and our volunteers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, opportunity or goodwill, arising from or related to your use of, or inability to use, the Site or its content, even if we were told such damages were possible. Because the Site is free and informational, our total liability for any claim relating to the Site is limited to one hundred US dollars (US $100).

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.

12. Indemnification

You agree to hold harmless and indemnify us and our volunteers from any claims, losses or expenses, including reasonable legal fees, that arise from your misuse of the Site, your breach of these Terms, or content you submit that infringes someone else's rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought only in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts. Before filing any claim, we ask that you first contact us at [email protected] so we can try to resolve the issue informally. If you live in a country whose laws give you the right to bring claims in your local courts, these Terms do not take that right away.

We may update these Terms from time to time. When we do, we will post the new version on this page and update the effective date above. Changes apply from the date they are posted. If you keep using the Site after a change, you accept the updated Terms.

We may change, pause or discontinue any part of the Site, including articles, tools such as the packing checklist, or the newsletter, at any time and without liability.

Suspension

We may restrict or block anyone's access to the Site or our forms if we reasonably believe they have broken these Terms or are misusing the Site.

15. General terms

• Entire agreement: these Terms, together with the policies linked above, are the entire agreement between you and us about the Site.
• Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
• No waiver: if we do not enforce a part of these Terms, that does not mean we give up the right to enforce it later.
• Assignment: we may transfer these Terms to a future operator of the Site. You may not transfer your rights under these Terms without our consent.
• Headings: section headings are for convenience only and do not affect meaning.
